Terms of Service and Policies

Welcome to the Paul Chiang Art Center Online Service Platform (hereinafter referred to as "the Website"). 

Before using any services on this Website, please carefully read, understand, and agree to accept the Website’s terms of service, privacy policy, and disclaimer. 

If you do not agree, please stop using the services immediately. 

When you begin using the Website’s services, you are deemed to have understood and agreed to all terms, policies, and statements. 

Additionally, some specific functions on this Website may have supplementary terms or regulations based on their nature, which are considered part of the Website’s terms, policies, and statements.

1. Terms of Service

(i) Acknowledgment and Acceptance

The Paul Chiang Art Center Online Service Platform provides all services (hereinafter referred to as "the Service") according to these terms.

 (ii) Use of Services

1. Once users make an online purchase on this Website, they agree to buy the product or service and comply with transaction rules. Users must immediately update any changes to their information (such as address, phone number) online and cannot deny their purchase or refuse payment due to discrepancies in information. The Website reserves the right to accept or reject your order.
2. For all online purchases made on this Website, users agree that the electronic transaction data recorded by the Website is final. In case of disputes, this electronic transaction data will be used as the standard for determination. If users discover incorrect transaction data, they should immediately notify customer service.
3. The Website may suspend or interrupt services in the following situations (users will generally be notified in advance, except in emergencies):

• Necessary maintenance and work on electronic communication equipment
• Sudden electronic communication equipment failure
• Difficulties in providing service due to suspension of electronic communication services
• Force majeure events such as natural disasters preventing service provision

• Uploading, posting, publishing, or storing any false, defamatory, insulting, threatening, offensive, indecent, criminal, or otherwise illegal content
• Uploading, posting, publishing, or storing any content containing computer trojans, viruses, or any code that interrupts, destroys, or limits computer software or hardware functionality
• Disrupting or interfering with system operations, or collecting others’ personal data without consent
• Violating confidentiality obligations under law or this Service
• Other actions that violate laws or regulations

 (iii) Registration Obligations, Account and Password Security

• To use this Service, you agree to provide accurate and complete personal information as prompted during registration, and maintain and update this information to ensure it remains correct, current, and complete. 

If you provide any incomplete, incorrect, or false information, the Website reserves the right to suspend or terminate your account and refuse your use of all or part of the Website.

• After completing registration, you will receive an account and password. This account is non-transferable, and you are responsible for all activities using this account. You are responsible for maintaining the confidentiality and security of this account and password. 

If you suspect your account has been compromised or encounter any other security issues, you must immediately notify customer service or email service@fontrip.com.tw.

(iv) Copyright Protection and Infringement Handling

• You retain ownership rights to any data you upload, input, or provide to the Website. However, by uploading, inputting, or providing data to the Website, you grant the Website permission to use, modify, distribute, reproduce, or publicly display such data within the scope necessary for providing the Service, and may sublicense these rights to others within this scope. If you do not have legal rights to authorize others to use, modify, distribute, reproduce, or publicly display certain data and sublicense these rights to third parties, do not upload, input, or provide such data to the Service. You guarantee that the Service’s use, modification, distribution, reproduction, public display, or sublicensing of such data will not infringe upon any third party’s rights, otherwise, you shall be liable for damages.
• All content on the Website is protected by copyright. If you wish to quote or repost content, except where explicitly permitted by law, you must obtain prior written consent from the Service or other rights holders. Any violation may result in liability for damages. Respecting intellectual property rights is your obligation; violations may result in liability for damages (including but not limited to litigation and attorney fees).
• Following the principle of respecting intellectual property rights, you agree that when using the Service, you must own the relevant intellectual property rights to the content and guarantee that the content does not violate copyright laws or other regulations. If you engage in infringement while using the Service, the Service may suspend all or part of your access. For serious infringement cases, the Service may refuse or terminate all or part of your service. You understand and agree that the Website reserves the right to modify, restrict use of, temporarily or permanently discontinue the Website (or any part thereof) at any time without notice and without any liability to you. 

You have no right to claim any damages for any modification, restriction, temporary or permanent discontinuation of the Service.

(vi) Online Transaction Notes

• When members complete an online ordering process, the Website will automatically send a notification email. This notification only indicates that the Website has received the order message and does not mean the transaction is complete. The Website reserves the right to accept the order. Members can check ordering status on the Website.
• When members complete the ordering process using this Service, they are making a purchase offer and agreeing to these terms of service and the transaction conditions or limitations stated on the webpage. If members’ personal information (e.g., address, phone number) changes after ordering, they should immediately update it online and cannot deny the order or refuse payment due to information changes. For any disputes regarding online transactions through this Service, the Website’s electronic transaction records will be the standard. If any transaction data is found to be incorrect, please notify customer service or email service@fontrip.com.tw.

(vii) Links to Other Websites

The Website or third parties may provide links to other websites or internet resources. You may be directed to websites operated by other providers, but this does not imply any relationship between the Website and these providers. Websites operated by other providers are their sole responsibility and are not within the Website’s control or responsibility. The Website does not guarantee the suitability, reliability, timeliness, validity, accuracy, or completeness of any search results or external links. (viii) Limitation of Liability

To the extent permitted by law, you may only claim compensation for direct damages. The Website’s total liability for your claims will not exceed the total amount you paid to use the Service.

 (ix) Collection, Processing, and Use of Personal Data Notice

Please read the membership application agreement carefully. By joining as a member, you agree to comply with the following regulations.

• To provide good service and protect your rights, the Website will collect and process personal data you provide within necessary purposes, such as: name, title, address, work address, home phone number, mobile phone, online platform account, communication address, email address, records of internet identity authentication or query services, and any other identifiable personal data. This will be limited to use by Paul Chiang Art Center for business registration items, statutory requirements, consumer/customer management and service, marketing, consumer behavior analysis, (market) research, statistics and research analysis, product development, online shopping and other e-commerce services and business-related services. 

The period of use is from the date of acquisition until the end date of the specific purpose. 

You agree that Paul Chiang Art Center may provide your personal data to third parties (including but not limited to shipping vendors, logistics vendors, service/product providers, or third parties offering services or preferential products) for processing and use based on the above purposes. 

The Website will properly protect your personal information in accordance with the "Personal Data Protection Act”.

Under this premise, you agree that Paul Chiang Art Center may process and use relevant data within the scope permitted by law to provide information or services, and may provide you with preferential information within the company’s operating area. However, you may still exercise your legal rights regarding personal information as follows: inquiry, viewing, copying, supplementing, correcting, processing, using, and deleting. Please contact the company by email during business hours.

You may also refuse to provide relevant personal data, but this may prevent you from enjoying the activities provided by Paul Chiang Art Center and the right to obtain various information in a timely manner.

The Website has established a strict security management system and, without violating the collection purpose, will use data via the internet, email, written form, fax, and other legal methods. Additionally, in circumstances required by law or judicial/administrative orders, to maintain the Website’s normal operation and security, to protect other users or third parties’ legal rights, or to manage and maintain quality, your personal data may be viewed or provided to judicial authorities, competent authorities, or third parties who provide appropriate evidence claiming their rights have been infringed. Except for the aforementioned circumstances, without your consent, the Website will never disclose personal data to third parties outside the Website. If you violate these terms of service, infringe upon others’ rights, or cause any third party to make claims or assertions due to content you provide, post, or transmit through the Website, use of the Service, or connection to the Service, you agree to indemnify the Website and its agents and employees against any damages. If the Website and its agents or employees suffer damages due to your actions, you agree to compensate the Service and its agents and employees for damages (including but not limited to litigation and attorney fees).

If the Website experiences interruptions or failures, this may cause inconvenience, data loss, errors, or other economic losses. Except in cases of intentional or gross negligence, the Website is not liable for any damages caused by your use (or inability to use) the Service.

The interpretation and application of these terms of service, and any disputes related to these terms, shall be governed by the laws of the Republic of China (Taiwan), unless otherwise provided by law, and shall be subject to the jurisdiction of the Taiwan Taichung District Court as the court of first instance.

If any provision of these terms of service is found invalid by a court of competent jurisdiction, the remaining provisions shall remain fully effective.

The Website may modify these terms of service in accordance with changes to the Website content or new applicable laws, and will post notifications on the Website without individually notifying users. Users shall agree to comply with the modified terms.
